What is a Will and Why Do I Need One? 2026 Update

What is Will and Why Do I Need One?
Let us talk about something most of us prefer not to think about.

Only around 40% of the adults in the UK have a Last Will (Testament). That means the majority of people have no say in what happens to their money, home or even their pets when they are gone.

If that includes you, do not worry – you are not alone. And the good news is, it is much simpler to sort than most people think.

SO, WHAT ACTUALLY IS A WILL?

A Will (formally called a Last Will and Testament) is a legal document that sets out your wishes for what should happen to everything you own after you pass away, your estate.

This includes your property, savings, personal belongings and even who you would like to care for your children or pets.

Without a Will, the law decides how your estate is distributed and it may not reflect what you would have wanted.

HOW DO YOU WRITE A WILL?

A valid Will in England and Wales must:

  1. Be written down

  2. Be signed by you in the presence of two independent witnesses

  3. Be signed by both witnesses in your presence

WHY DO YOU NEED ONE?

Here are three of the most important reasons:

1. To protect your loved ones

A Will ensures the people you care about most are provided for in the way you intend.

2. To avoid family disputes

A clearly written Will removes uncertainty and helps prevent conflict.

3. To protect your pets

A Will allows you to name someone you trust to take care of them and even set aside funds for their care.
