Family law solicitors advise and support clients with legal issues involving children, relationships, and marriage—including divorce, child arrangements, financial disputes, care proceedings, and domestic abuse. We guide you carefully through every step, always with your best interests at heart.
Yes. In England and Wales, you can apply for a divorce even if your partner does not give consent, thanks to the “no-fault” divorce process. The court will process your application and issue your divorce if you meet legal requirements.
The timescale will depend on your situation, court processing times, and any complications such as financial arrangements or child disputes. Many divorces are completed in six to eight months, but cases can move faster or slower depending on the details.
Where you and any children live after separation depends on your family’s needs, ownership, financial matters, and sometimes urgent circumstances. We can talk you through your rights and help negotiate arrangements that are fair and in the children’s best interests.
Parents are encouraged to agree arrangements (sometimes called “child arrangements”) themselves. If you cannot agree, a court may decide where children live, when they see each parent, and who makes key decisions—always based on what’s best for the child.
No. The law treats both parents equally, and decisions are based on the child’s welfare—not gender. Courts consider many factors, including existing routines and the child’s wishes if appropriate.
If there are genuine child safety concerns, the court can restrict time. But, except in rare cases, courts believe children benefit from meaningful relationships with both parents. If you are being prevented from seeing your children without good reason, you can seek legal help.
Before most court applications about children or finances, you are expected to attend a Mediation Information and Assessment Meeting (MIAM) to see if issues can be resolved out of court. There are exceptions (for example, domestic abuse). We can explain whether mediation is required in your case.
Child maintenance is usually agreed between parents but can also be calculated by the Child Maintenance Service or ordered by the court. The amount is based on parents’ incomes and the child’s needs. If you have trouble agreeing, we can advise you on your options.
If your child is in immediate danger, you should contact the police. For urgent legal protection (such as emergency court orders to keep a child safe), speak to us as soon as possible. We can act quickly to protect your child’s wellbeing and your rights.
Grandparents do not automatically have a legal right, but they can ask the court for permission to apply for contact if agreement with the parents is not possible. Courts recognise the value of children having strong family connections.
